Terms of Service

1. DEFINITIONS

1.1 "Member" means a user who has registered an account on the HeimaTorg platform.
1.2 "Task" means the job or service posted by a Member on HeimaTorg.
1.3 "Task Contract" means the agreement concluded between Members concerning the performance of a Task.
1.4 "HeimaTorg Platform" means the online platform operated by HeimaTorg that facilitates the posting and completion of Tasks.
1.5 "Service Fee" means the fee charged by HeimaTorg for the use of the platform’s services.

2. GENERAL CONDITIONS

2.1 By registering on HeimaTorg, Members accept these Terms of Service and any other applicable rules.
2.2 Members agree to use the platform only for lawful purposes and not to violate any laws or rights of others.
2.3 HeimaTorg reserves the right to suspend or delete accounts in case of breaches of the Terms of Service.

3. REGISTRATION AND ACCOUNT

3.1 To use HeimaTorg, the user must register an account and provide accurate information.
3.2 The Member is responsible for maintaining the confidentiality of login credentials and all activities under their account.
3.3 Members must notify HeimaTorg immediately of any unauthorized use or security breach.

4. POSTING TASKS

4.1 Members may post Tasks with clear descriptions, deadlines, and budgets.
4.2 By posting a Task, the Member confirms that they have the right to request the Task and that the Task does not violate any law.
4.3 HeimaTorg does not guarantee the execution or quality of any Task.

5. TASK CONTRACTS BETWEEN MEMBERS

5.1 A Task Contract is formed when a Member accepts a Task posted by another Member.
5.2 HeimaTorg acts only as an intermediary and is not a party to the Task Contract.
5.3 All disputes arising from Task Contracts must be resolved between the Members involved.
5.4 HeimaTorg is not responsible for the content or execution of any Task Contract.

6. SERVICE FEE

6.1 HeimaTorg charges a Service Fee for the use of its platform, calculated as a percentage of the Task value.
6.2 The Service Fee is payable upon successful conclusion of a Task Contract.
6.3 The Service Fee is non-refundable.

7. PAYMENT AND WITHDRAWALS

7.1 Payments related to Tasks are processed through HeimaTorg’s authorized payment service provider.
7.2 Members must verify their identity for payment withdrawals according to Icelandic law (e.g., providing valid ID).
7.3 HeimaTorg does not store sensitive personal identification documents but relies on third-party processors for verification.
7.4 HeimaTorg reserves the right to withhold payments if misuse or fraud is suspected.

8. CANCELLATION AND TERMINATION

8.1 Members may cancel Tasks before they are accepted by other Members.
8.2 Once a Task Contract is formed, cancellation rights may be restricted in accordance with Icelandic consumer protection laws.
8.3 HeimaTorg may suspend or terminate any account violating these Terms.

9. MEMBER COMMUNICATION

9.1 Members consent to receive communication from HeimaTorg via phone, postal mail, or electronic mail for platform optimization and support purposes.
9.2 HeimaTorg may contact Members even if such communication is not related directly to Tasks.

10. RIGHT OF WITHDRAWAL

10.1 Members acknowledge that by posting or accepting Tasks on HeimaTorg, the general rules on withdrawal rights under Icelandic law (similar to the EU Consumer Rights Directive) may not apply or may be limited.
10.2 Upon creation of a Task Contract, the service by HeimaTorg is considered delivered, and withdrawal rights against HeimaTorg cease accordingly.
10.3 This does not affect any withdrawal rights between Members in their Task Contract.

11. DATA PROTECTION

11.1 By providing personal information (name, phone number, email, job details), Members consent that such data may be visible to other Members as necessary for the platform’s business model.
11.2 HeimaTorg will take reasonable measures to protect Members’ data and will not disclose it to third parties except as necessary for service provision or legal obligations.
11.3 Members may update or delete their profile data at any time via the "Edit Profile" menu.
11.4 Members may terminate their account by emailing HeimaTorg support.

12. CHANGES TO TERMS

12.1 HeimaTorg reserves the right to modify these Terms of Service.
12.2 Significant changes will be communicated to Members by email and published on the HeimaTorg website.

13. PAYMENT PROCESSOR

13.1 HeimaTorg uses a third-party payment processor to handle payments and payouts according to these Terms.
13.2 Members agree to the payment processor’s terms, which are accessible at the processor’s official website.

14. COOKIES

14.1 HeimaTorg uses cookies and similar technologies to verify Members, analyze website traffic, remember preferences, and improve the platform.
14.2 Members may accept or decline cookies through their browser settings.
14.3 Most browsers accept cookies by default; instructions to disable them are typically found under "Help" or "Settings."

15. MISCELLANEOUS PROVISIONS

15.1 If any provision of these Terms becomes invalid or unenforceable, the parties will seek to replace it with a legally valid provision closest in effect.
15.2 Invalidity or unenforceability of one provision does not affect the validity of the remaining Terms.

16. GOVERNING LAW AND DISPUTES

16.1 These Terms shall be governed by Icelandic law.
16.2 Any disputes arising between HeimaTorg and a Member shall be resolved in Icelandic courts, with the district court in Reykjavík as the venue of first instance.
